Terms and Conditions of Hire

1) CONTRACT OF HIRE
is between the Hirer and the Mr Nicholas Stanley (known as the Owner). The contract shall be deemed to be made subject to these terms and conditions of Hire and governed by English Law. Any actions shall be heard in the court for the area in which this property is located. 
The contract is for the hire of the property for holiday purposes only. 
The property may not be sublet. 
The owner does not accept bookings from Hirers under the age of 18. 

2) THE MAIN CONDITION OF ACCEPTANCE
of any bookings is that good care is taken of the property, and contents and that it is left truly clean and tidy as we intended you to find it. This care is to include all utensils, crockery, equipment, linen, fixtures and fittings. While you may not necessarily be charged for minor items you should be aware that all damages and breakages are the Hirer’s responsibility and the cost of repair/replacement will be payable on demand. The lead name/Hirer on the booking form will be held responsible for the behaviour of the party and for the condition in which the property is left at the end of the stay. 

3) A ‘GOOD HOUSEKEEPING DEPOSIT’
of £150 is payable by cheque when paying the balance or prior to arrival. The property will be inspected after departure and the GHD is refundable within 21 days of the holiday completion date. To maintain high standards of cleanliness the property is non-smoking and the GH deposit may be forfeited should deep cleaning be required for whatever reason. 

4) HOLIDAYS
Are from 5.00pm on arrival day until 10.00am on departure day. 

5) KEYS
Will be available on arrival from the host. A lost key will be subject to £50 surcharge to cover the cost of lock and key replacement. 

6) PAYMENT
A deposit of 50% is payable at the time of booking to secure the reservation. The balance is due 8 weeks before the first day of the holiday. Where a booking is made less than 8 weeks before arrival the full rental is payable upon booking. 

7) CONFIRMATION
Following receipt of the Booking and Deposit, you will be sent the Confirmation of Booking. A contract is thus formed between you and the Owner and you are then responsible for the balance of any rental and additional charges. 

8) OCCUPATION
The property is offered only on the understanding that no more than the stated agreed number of people (maximum 10), unless agreed otherwise at the time of booking. 

9) APPROPRIATE USE
As the property is designed for family holidays the Owner reserves the right to refuse or curtail any booking which may in the Owner’s opinion, by reason of number or composition, be unsuitable for the property. 

10) DEFAULT
If for any reason, beyond the Owner’s control, the property is not available, or has been rendered unsuitable for holiday letting (eg by fire, water damage or any other fault) for the date booked, the Owner will offer a full refund for all rent and charges paid by the Hirer and there will be no further claim against the Owner.

11) LOSS OR DAMAGE
No liability is accepted for any loss, damage, sickness or injury howsoever caused which may be sustained during the holiday to the Hirer or any member of the party or any invited person, or any vehicle, its contents, or any possession of the Hirer or any member of the party as defined above. 

12) PETS
Are permitted in the property and are subject to a payment of a pet charge (£20 each) on the understanding that a solid bed is provided by the hirer and used only on the ground floor. Pets are NOT allowed onto the furniture, on the first floor – in the bathrooms or into the bedrooms – must not be left alone in the property, must be ‘well behaved’, no sign of the pet should be evident in the property on departure and no nuisance or annoyance caused to neighbours. The garden is enclosed but we cannot guarantee it to be secure for your dog. You will be required to leave immediately, without refund, if you are in breach of any part of this condition. We would respectfully remind pet owners to remove any dog mess in the grounds. 

13) FUEL
Electricity and heat are included in the rent although the Owner reserves the right to charge for any excessive use of utilities. Wood fuel for the fires is provided. 

14) COT
Available on request. Please bring your own cot bedding. We do not provide high chairs. 

15) EQUIPMENT
The property is equipped with sufficient crockery, cutlery, kitchen equipment (inc tea towels), dining and easy chairs, beds, towels (hand and bath towel), bedding and bed linen for the standard number of people indicated. All food, washing-up liquid, dishwasher and washing machine powders should be brought by the Hirer. A full inventory is available upon request. 

16) PARKING
There is parking space for max 10 vehicles at the front of the property. If you plan to bring more than the stated max amount of cars, or a boat, please advise us before arrival. 

17) COSTS
The Owner cannot accept liability for any alternative accommodation costs, short term equipment failure or problems beyond their reasonable control. Please contact the Owner immediately should a problem arise. 

18) CANCELLATION BY THE HIRER 
Holiday cancellation insurance is not provided by the Owner and is not included in the price of the holiday. You should therefore satisfy yourself that holiday/travel/cancellation insurance appropriate to your own circumstances is available from a source regulated by the Financial Services Authority. 

In the event that you have to cancel your holiday you must notify us immediately and in writing of any intention to cancel the holiday. The cancellation only takes effect when the Owner has received written confirmation by the Hirer. If the Hirer cancels, they are still liable for the payment of the balance. 

The Owner shall seek to re-let the property at the best possible price but not necessarily at the advertised web site price. If the holiday accommodation is re-let, monies received by us for the re-let holiday, less any discount offered in order to obtain another booking, less the any ‘extras’ already paid and a handling charge of £50 will be refunded within 2 weeks after the re-let holiday has taken place. 

If we are unable to re-let the holiday accommodation for the period of the cancelled holiday, all monies paid by the Hirer to the Owner shall be forfeited.

No refunds will be given on cancelled short break holidays or bookings made within the immediate 4 weeks before the commencement of the holiday, whether or not the holiday accommodation is re-let. 

19) WEBSITE ACCURACY
relating to the property details are correct at the time of publishing, the Owner reserves the right to make alterations to the web site at any time and shall endeavour to inform the Hirer of any such alterations. 

20) LOST PROPERTY ITEMS
Will be retained by the Owner at their premises for 28 days only, from date of departure. Items to be returned to the Hirer are charged at a flat fee of £10 plus P&P, payment of which can be made by electronic payment BACS via your bank or cheque. The Owner does not accept responsibility for returning any items and do not return any food or drink items.

By car
From the M6 – Leave the M6 at junction 36, then at the roundabout take the 1st exit onto the A590 proceed for 3.5miles. At the next junction (Brettargh Holt) branch left, then at the roundabout take the 1st exit onto the A590 signposted Barrow. Proceed for 5 miles. As the road emerges from single lane to dual carriageway turn right, sign posted Witherslack and brown tourism sign ‘Halecat’. Crossing a cattle grid you will pass the village shop and The Derby Arms on your left hand side. Continue straight on into the village for half a mile taking the first left following the Halecat sign. Proceed for half a mile and take a left turn and then immediately left again onto Halecat drive – large wooden signpost. Continue down the drive and keep right at the fork, do not enter the garden centre car park, and park at the front of the house.

Bus Service
There is a X6 service bus every hour (20mins past the hour) which stops on the A590, west and east close to The Derby Arms. The route stops at Grange Over Sands railway station.

Railway
Frequent trains from across the North West pass through Grange Over Sands with direct routes from Manchester Airport. If you are travelling from further afield, connections can be made at Carnforth, Lancaster or Preston. If travelling on the main line use Oxenholme Lake District (OXN).

Taxis
Taxis can be arranged to/from the station. Airports The nearest airports are Blackpool, Manchester or Liverpool.
